Christina Aguilera was arrested last night in West Hollywood after her boyfriend, Matthew Rutler, was pulled over for erratic driving.

They were stopped around 2:45 a.m. near Sunset Boulevard and Clark Street.

Rutler was arrested and booked on a misdemeanor charge of driving under the influence of alcohol while Aguilera was booked for a misdemeanor charge of public intoxication.

Rutler was held on a $5,000 bail at the sheriff’s West Hollywood station.

The pop star was released around 7:30 a.m. on a $250 bail.

Sheriff’s spokesman Steve Whitmore said Aguilera was arrested under a law covering “public welfare; public safety.”

“She was not capable of taking care of herself.  She was incapacitated.  She was cooperative. She was not belligerent in any way whatsoever; she was just intoxicated,” Whitmore said.

Whitmore said the arrest will appear on Aguilera’s record, but the sheriff’s department has no intention of prosecuting her, and she will not have to make a court appearance.
